North Brother Fitness provides gym memberships, coaching services, classes, events, and fitness-related services. Built by Effort provides apparel, merchandise, and online retail products. We reserve the right to amend these Terms and Conditions at any time without prior notice. Continued use of the website after changes are made constitutes acceptance of those updates.

All memberships, classes, coaching services, personal training sessions, recovery services, and event bookings are subject to availability. We reserve the right to change schedules, coaches, programming, opening hours, or cancel services where necessary. Members and visitors are expected to follow all gym rules, safety instructions, and staff directions while on our premises.

Participation in exercise, fitness classes, strength training, Olympic lifting, competitions, or recovery services involves inherent risks, including injury, illness, or physical strain. By participating in any service with North Brother Fitness, you acknowledge these risks and agree that you participate voluntarily and at your own risk, except where liability cannot be excluded under Australian Consumer Law.

All event and competition registrations are subject to the rules and conditions set out for that specific event. We reserve the right to alter workouts, schedules, scoring systems, venues, divisions, prize structures, or heat times if required. Unless otherwise stated, registration fees are non-refundable. Judges’ decisions and event organiser decisions are final.

All prices on the Built by Effort online store are listed in Australian Dollars (AUD) and include GST where applicable. We reserve the right to change pricing at any time. Orders are subject to availability and acceptance. If an item becomes unavailable, contains a pricing error, or we suspect fraudulent activity, we may cancel the order and issue a refund where required.

We aim to dispatch orders promptly; however, shipping timeframes are estimates only. We are not responsible for delays caused by postal carriers, customs, weather events, or incorrect delivery details supplied by the customer. Ownership and risk of goods pass to the customer once the order has been delivered.

Returns and exchanges are handled in accordance with Australian Consumer Law. If a product is faulty, damaged, or not as described, you may be entitled to a repair, replacement, or refund. Change-of-mind returns may be accepted at our discretion if items are unworn, unused, in original condition, and returned within the specified timeframe. For hygiene reasons, certain items such as worn activewear or intimate garments may not be eligible for return unless faulty.

Any promotions, discount codes, giveaways, or gift cards may be subject to separate terms including expiry dates, usage limits, and exclusions. Promotions cannot be combined unless expressly stated.

All content on this website, including logos, branding, graphics, text, photos, videos, training materials, and product designs, remains the property of North Brother Fitness or Built by Effort unless otherwise stated. No content may be copied, reproduced, distributed, or used without prior written permission.

These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes arising in connection with these Terms shall be subject to the jurisdiction of the courts of New South Wales.
